GENERAL TERMS AND CONDITIONS
The following terms and conditions apply to all users and their companies (hereafter also known as Agent) of TravelOP Pte Ltd Marketplace Website (https://www.travelop.co) hereafter also known as TravelOP. Agents here refer to individuals who contract for and on behalf of their companies and include other staff from the same organisation who may be given access to use the Website.
Rights for Usage
As a condition to use this Website, you warrant that you (i) are at least 18 years of age, (ii) possess the legal authority to create a binding legal obligation, (iii) will use this Website in accordance with its Terms & Conditions and (iv) all information supplied by you on this Website are true, accurate, current and complete. We retain the right, at our sole discretion, to deny access to anyone to this Website and the services we offer, at any time and for any reasons, including but not limited to this set of Terms & Conditions.
Agent acknowledges that TravelOP owns all right, title and interest in all intellectual property rights, including all content, logos, trade names, trademarks and service marks, and any content, data, software, technology, tools or business methods used by TravelOP to develop, promote, market, sell, and distribute the Products (collectively the “TravelOP Intellectual Property”). Nothing in this Agreement shall be deemed or construed as a transfer of any TravelOP Intellectual Property to the Agent. Any Intellection Property breach will result in the immediate termination of access to the Website and the forfeit of any remaining deposit.
Search Engine Marketing
a) TravelOP reserves the right to inform Agent to refrain from running Search Engine Marketing or Search Engine Optimisation campaigns for specific keywords. b) Agent must act on (a) to discontinue the campaign in question. If agent does not discontinue the campaign within 24 hours of notice, TravelOP reserves the right to terminate access to the platform.
Full payment via credit card is always required at time of booking unless you have an approved alternative payment arrangement and scheme. All prices and availability of specified booked dates are guaranteed only after full payment is received by TravelOP. Users should always verify currency, inclusion of government taxes, service charges and any other fees, any inclusion or exclusion of benefits before confirmation with your clients.
When payments are overdue and exceed the credit term provided, TravelOP reserves the right to impose a penalty and/or interest to the outstanding amount, in accordance to local interest rate levels and practises. If such local standards are not available, TravelOP have the right to use its corporate financing terms.
Due to direct connectivity with operators that create a dynamic status, prices may change from time of enquiry to confirmation. Therefore, it is highly recommended that users attain confirmation of booking and price before final confirmation to clients. Adjustments of pricing will not be made after payment is made. In the event that an operator eases prices, any such reductions will also not be made retroactively.
TravelOP also reserves the right to correct any unintended errors in pricing without any prior notice but for any existing bookings not yet paid, agents will be contacted and re-invoice accordingly.
All agent accounts will use US Dollar for the purpose of invoice and payment. Prices shows using the currency convertor are based on currency exchange sources and should be used for references only. Payment for bookings will always be in US Dollars.
Each product has its own set of cancellation policies as implemented by its operator or provider. All users are advised to check the applicable policies as it can differ by products, dates and methods of payment. On payment of all bookings, it is deemed that the user has accepted the corresponding set of policies. The cancellation policy can be found on the checkout page.
Products and services in TravelOP carry different sets of refund policies based on its cancellation policies. The right to refund can also be limited to changes in travel dates as allowed by respective operators and/or decline of service due to termination of operations. No refunds will be issued or exchange made for any missed or unused products and services features, components or unused hotel nights for any other reasons. TravelOP is not responsible for free components provided by third party vendors. All free components have no cash value.
Requests for refunds must be submitted in writing to TravelOP no later than 10 days after the departure dates with the necessary supporting documents.
All refunds are subject to conditions as outlined under cancellations, changes and revisions, and are further subject to any handling or administrative fees as imposed by TravelOP or its service operators and third party. Acceptance of a refund constitutes a waiver by the customer of all other rights and remedies under applicable laws other than the amount of the refund sought.
If a refund to the agent is granted by TravelOP or its service providers, the amount of refund will be in US dollars and can only be up to the price charged for the product or service concerned less any administrative, handling or remittance fees. If the agent had engaged an alternative product or service provider and as a result incurred a higher cost, TravelOP or its service providers will not be held liable. Any replacement of product or service, as long as not offered or provided by TravelOP or its suppliers, are deemed to be engaged by the agent at their own discretion and TravelOP and its service operators and providers cannot be held responsible for the price difference or standard experienced by the agent or their clients. It is the responsibility of the traveller to comply with travel documentation requirements; no refunds will be made for improper or fraudulent travel documentation.
Special Travel Requests
Activity providers do not necessarily have the appropriate special services and equipment to accommodate persons with disabilities or special needs. Agents are advised to contact directly to the tour operator who provide the content.
Indemnity of Liabilities
TravelOP is a wholesaler, an independent contractor and aggregator, which makes arrangements with operators and third party vendors for all travel products. TravelOP is not an agent of the customer or of other parties providing travel-related services. All travel documents issued are further subjected to the terms and conditions specified by its vendors.
This Website may contain hyperlinks to websites operated by parties other than TravelOP. Such hyperlinks are provided for references only and TravelOP is not responsible for accuracy of their content, the privacy acts or other practices of such websites and that such sites are free of any anti PC or software programs such as viruses, worms, trojan horses, cookies, defects and other items of a destructive nature.
Neither TravelOP nor any of its appointed agents or employees shall be held liable for, and by accepting these documents, users, their companies and clients waive any claims against all parties for a) any loss of or damage to property or injury to any person caused by reason of a defect, negligence or other wrongful act or omission of or any failure of performance of any kind by any other transportation company, vendor or supplier; b) any inconvenience, loss of enjoyment, mental distress or other similar matter; c) any delayed departure, missed connections, substitutions of accommodations, termination of service or changes in fares and rates; and d) any cancellation or double-booking of reservations, tickets or packages beyond the control of TravelOP.
In no event shall TravelOP be responsible for any amount other than the price paid by the Agent for the tour or package. TravelOP reserves the right to accept, decline, retain or remove any person as a member of the tour package program or group at any time.
Each Agent agrees that all disputes in any matters whatsoever arising in connection with the responsibility of TravelOP under this Agreement shall be construed and enforced in accordance with the laws of Singapore, and each Agent consents to the courts Singapore, being the sole venue of any action related to this agreement, to the exclusion of the courts in any other state or country. Each Agent waives its rights to a jury trial.
TravelOP shall not be responsible for schedule changes and cancellations, fares or rate changes, errors or omissions of service details and operational procedures as implemented by its service operators and providers.
Right to Refusal and Termination of Contract & Service
TravelOP adopts a policy of refusal and/or termination, under appropriate circumstances at its sole discretion. Circumstances include conflict of interest, infringement of data rights, abuse of system data, products & services, features and functions and can include the legal policies of the countries concerned. TravelOP may also at its sole discretion limit access to the Site and/or terminate the accounts of any Agents who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
Responsibilities of Agents and their Companies/Accounts
All IDs and Passwords issued are confidential information and the account users and their companies must ensure due diligence so that such information are not mishandled or lost. All rates published are strictly confidential, and any breach of this confidentiality would result in the immediate termination of access to the TravelOP for Agents Website and all deposits forefeited.
If there is unauthorised usage, bookings or alterations made within such accounts, with or without the management or owner's knowledge, the account's users, management or owner, are responsible for the charges accordingly.
If there is a suspected breach of security, all users, their management or owners, must immediately contact TravelOP to report their findings or suspicion. TravelOP can legally pursue any individuals or companies that it suspects to have caused any infringement of rights or breach of security, to its system, offices and staff.
